Criminal Defense Attorneys
If you are a criminal defense lawyer you may come across a client who is not a United States citizen. As a result, your client's conviction may trigger removal proceedings against him or her. It is always advisable to ask your client his or her immigration status prior to starting plea negotiations. Also, as a general rule, if a conviction can be pled down to a violation or a misdemeanor, your client has a better chance of being eligible for relief from removal (it may not completely prevent the initiation of removal proceedings, but at the very least, your client may have the opportunity to seek relief from removal).
